1. Acceptance of Terms
By accessing or using PromptDefend ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Service
PromptDefend provides AI security and monitoring services, including but not limited to prompt injection detection, data leak prevention, PII redaction, and observability tools for LLM applications.
3. Subscription & Payments
3.1 Pricing Tiers: We offer Free, Pro, Pioneer, and Enterprise subscription tiers. Features, limits, and pricing for each tier are described on our Pricing page and are subject to change.
3.2 Billing: Paid subscriptions are billed in advance on a recurring monthly or annual basis. You agree to provide accurate billing information and authorize us to charge your payment method.
3.3 Cancellation: You may cancel your subscription at any time. Your service will continue until the end of your current billing period. No refunds are provided for partial subscription periods.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and API keys. You are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these terms.
5. Service Level Agreement (SLA) & Availability
We strive to maintain 99.9% uptime for our API services. However, strictly "as is" and "as available." We do not guarantee effective detection of all security threats, as AI attack vectors are constantly evolving. Occasional maintenance or force majeure events may cause downtime.
6. Data Privacy & Security
6.1 Data Processing: We process data sent to our API ("Input Data") solely for the purpose of providing security analysis. We do not use your Input Data to train our core models without explicit permission.
6.2 Confidentiality: Both parties agree to maintain the confidentiality of non-public information. We implement industry-standard security measures, including stateless architecture options where applicable.
6.3 PII Redaction: While our service includes PII redaction capabilities, you acknowledge that no automated system is 100% error-free. You remain the data controller for any personal data processed.
7. Acceptable Use
You agree not to use PromptDefend for any unlawful purpose, to probe, scan, or test the vulnerability of our system without authorization, or to reverse engineer our proprietary technology. Usage limits apply based on your subscription tier; exceeding these limits may result in rate limiting or overage charges.
8. Intellectual Property
All content, software, and technology of PromptDefend are the exclusive property of Prompt Defend and are protected by copyright, trademark, and other intellectual property laws. You retain all rights to your own application and data.
9. Indemnification
You agree to indemnify, defend, and hold harmless Prompt Defend Solutions, its officers, directors, and employees from any claims, liabilities, damages, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
10. Limitation of Liability
IN NO EVENT SHALL PROMPT DEFEND BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO PROMPT DEFEND IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of India. Any dispute arising from these Terms shall be resolved through binding arbitration in Bengaluru, Karnataka, India, in accordance with the Arbitration and Conciliation Act, 1996.
12. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance. Major changes will be communicated via email or dashboard notification.
